Thank you for choosing Aim2Game as your service provider. Everything we offer to you is subject to these Terms of Service and Acceptable Use Policy. It is extremely important you read this thoroughly, because ignorance of these terms after agreement will not be applicable cause to subjugate these terms. We may tweak the TOS/AUP at any time, and we may or may not let you know about it. So please, always make sure you keep on top of the latest version of the TOS/AUP at http://www.aim2game.com/TOS.html.
Aim2Game does their absolute best to make sure you have uninterrupted access to our services. But sometimes, due to either planned maintenance, unplanned downtime, network failure between yourself and the servers or other acts of God, access to our services may be interrupted. We also do our absolute best to make sure your experience with our services are as stellar as they can be, but sometimes, whether due to some mechanical failure or partial failure of the network between you and the services, or overuse of the services caused by constant use of the services, they could become sub-optimal. We affirm we are going to do everything humanly possible to make sure the services perform as expected, or we'll offer an alternative within our power if the services do not perform as expected.
Aim2Game also has a wide and varied way to obtain support from us. For starters, we suggest you idle #aim2game on the GameSurge network, and ask one of the staff for access or voice in the channel so we can easily identify you as a customer of ours. We also have #a2g-support, which we try to keep as available as humanly possible for your every reasonable whim. We also reserve the right to refuse to offer support at any time, and for any reason, but generally we try to make sure these cases are only when we feel our support services have been abused, or if noone is available to offer support. Abusing Aim2Game staff is strictly prohibited, and doing so may require us to submit any information required to law enforcement to protect our staff against verbal, physical and emotional harassment. Should a customer perform an action which requires an Aim2Game technician to make extensive repairs to the services, the customer may be billed for these repairs.
Before we release services for use, we must have full payment. No exceptions. Management of your services with Aim2Game is completely in your hands, and we do our best to provide you with the tools to effectively manage your services. We do not offer support for any third-party mods on a server, and we expect you will take reasonable steps to read any documentation before contacting us for support.
Upon signing up with Aim2Game, you affirm to us all information entered with us is true, accurate, current and complete. If we have a reason to believe the information entered with us is incorrect, Aim2Game will reserve the right to interrupt or terminate your service with us until reasonable steps are taken to correct the information entered with us within a 3-day grace period from first notification from Aim2Game about the information entered. Such time is not refundable, and termination resulting from inaccurate or incomplete information entered into our system is not refundable.
You agree you are of a legal age to make a binding contract. This is commonly understood as at least 18 years of age. If we suspect the account holder is under 18 years of age, we will take the same kind of action as if the information entered with us was incorrent.
The payment methods we currently accept are the following: Credit Card (Auto-charge) Subscription, Credit Card Manual payment, Paypal (Auto-charge) Subscriptions (including Instant and e-Check transactions), and manual Paypal payments (including Instant and e-Check transactions). By default, if you order with a Credit Card, you will be automatically put on a Credit Card (Auto-charge) Subscription, and upon agreeing to our TOS, you agree that you have the right to automatically charge the Credit Card on the account for renewals, and that you authorize Aim2Game to make these charges on your Credit Card on your behalf. Aim2game currently accepts Mastercard, Visa, and American Express credit cards. If you would like to pay manually with a CC, please submit a support request and let us know you would like to pay by CC Manual payment. PayPal e-Check transactions are processed as if they were Instant transactions, meaning if it is your initial signup order, we will treat it as we do any other payment method. However, if we find the PayPal e-Check is denied for any reason (failure to clear, cancelled by you, the Buyer, etc), we will take down services immediately, and you may be billed a $25 administrative fee. We reserve the right to interrupt service if funds are not received by the due date on your billing cycle. A fee may apply for reconnection of services and a credit will not be issued for the time your server was down due to lack of payment.
Our refund policy is a pro-rated policy: We will refund you the amount left on the term, rounded up to the nearest week. And, if you request a refund for whatever reason in the first 48 hours of service, we will refund the whole amount, minus a $5 administrative fee. For example: Between 2 and 7 calendar days after service has been set up on a monthly basis, we will refund up to 75% of the remaining total balance on the account. Between 7 and 14 calendar days, we will refund up to 50% of the remaining total balance on the account. Between 14 and 21 calendar days, we will refund up to 25% of the remaining total balance on the account. Between 21 and 30 calendar days, we will not offer a refund, but you are more than willing to cancel the account within this time.
Cancellations must be done at least 3 days before the next bill is due. We send an invoice out between three and six days before the bill is due, to let you know the bill is due and to give you the chance to cancel services with us. This gives us enough time to mark you as cancelled in our databases, and keeps us sane. The methods you can use to submit a cancellation are the same methods you can use to obtain support from Aim2Game. You MUST have confirmation of a cancellation by a Aim2Game representative for it to be a valid cancellation. Submitting a ticket for cancellation or saying you want to cancel your services via our methods of support is NOT valid confirmation of cancellation. Paypal subscription cancellations must be followed by a notice to us to let us know you wish to cancel. If we find the PayPal subscription was not cancelled after you submit a cancellation with us, we will refund the amount charged automatically by PayPal on your behalf, minus a $5 administrative fee. If we find that you did not gain confirmation of your intent to cancel, and your CC was charged, we will refund the amount charged to your credit card on your behalf by us, minus a $5 administrative fee. And finally, if we find a Paypal subscription was cancelled without notifying us, we will treat it as if you cancelled it with us, and we will take down the server immediately upon the end of your term.
Aim2Game doesn't sell, rent, or share personal information with anyone, except where law enforcement is concerned, or to place the information on a global blacklist database shared between other Game and Voice service providers for the sole sake of preventing fraudulent accounts being made across those using the database.
All usernames and passwords you provide to Aim2Game, and those we provide to you, must be kept confidential by you. You are responsible for the security of your account. If you suspect someone else may have your information, we implore you to take steps to change the passwords of the services you have registered with us, and you let us know about this breach of your security and work with us, so we can make sure noone else other than yourself access your services.
All content provided by you for use in your services are the sole responsibility of yourself, and not Aim2Game. You agree you won't use Aim2Game services to post graphics, video, messages or other content may be unlawful, threatening, abusive, invasive of others' privacy, or anything else that's generally considered bad. We'd list them all, but we feel you, our Customer, can gauge exactly what you shouldn't use Aim2Game services for. Please make sure whatever you transmit between yourself and Aim2Game complies with all applicable locality and country laws. This also means not sending or otherwise finding a way to export encrypted information found on your Aim2Game service to countries which the United States has an embargo against. You are also responsible to make suitable backups of any unique information or packages you'd like to hold on to, and we will not host these backups for you.
When it comes to exactly how much bandwidth and disk space you're allowed for your Aim2Game services, it goes like this: For Game servers, we respectfully ask you do not use more than 3GB of disk space in your account, and you only load into the FTP of your server which you need to run your Aim2Game Game server. We also request you do not modify the restricted parameters in your server, and usually this means not modifying your number of slots, the public or private status of your server, the frames per second or tickrate of your server, and not installing mods we do not support. You're not limited on bandwidth, of course, when it comes to Game or Voice servers. Voice servers don't really have a limit, all we ask is you do not attempt to modify the number of slots available for your Voice server. When it comes to Webspace, you will have a constant reminder available in the web panel you can refer to as your limits. We ask you not attempt to subvert those limits. Aim2Game reserves the right to modify or terminate service which breaks the guidelines of what you were offered or otherwise obtained from Aim2Game. You also understand unless you were specifically rented a package from Aim2Game to resell Aim2Game services, you are not at all allowed to resell or transfer our services.
You also agree to indemnify and hold harmless Aim2Game and it's employees, officers, agents, affiliates, and other partners. We do not have any control over third-party media, either hosted by Aim2Game themselves or on sites external from us. We don't have any control on what we link to, and are not responsible or liable for any damage or loss caused by these third parties. We also are not liable for any direct or indirect damages caused by the use of our services or the services of third parties. Some jurisdictions do not allow the exclusion of certain warranties. Some of the TOS/AUP may not apply to you. Whatever parts aren't legal in your locality may be stricken from inclusion for your particular case. The rest of the TOS/AUP stands, however, regardless of conditional exclusion. Please let us know at the time of signup if any local laws do not allow you to follow some part of this TOS/AUP. The failure or partial enforcement of any terms in this contract doesn't mean you can waiver the entire document, or waiver any part of the document at all. No other contract shall negate any part of our TOS/AUP, and we reserve the right to refuse service to anyone for any reason whatsoever. We also reserve the right to take any action we deem approprate against the account for any reason whatsoever, with or without notice and place any funds related to the account in any state we deem necessary for the situation.
